Annulment is filed for void and/or voidable marriage only. It could only be filed by a party, naming the other party as a respondent.
Example of Void marriage, (1) at the time of marriage, either party was already lawfully married to another person; (2) male person was under 18 years old and female was above 16 but below 18 without special licence by the chief minister; (3) parties within prohibited degrees of relationship.
For voidable marriage, i.e. (1) non-consummation due to incapacity of either party; (2) willful refusal to consummate; (3) no valid consent to marry; (4) mentally disordered; the other party suffering from venereal disease in a communicable form; (5) at the time of marriage, the wife was pregnant by another man and not the petitioner.
