Who can claim?
A family member, i.e. the wife, husband, parent (includes father, mother, grandfather and grandmother), child (includes son, daughter, grandson, granddaughter, stepson and stepdaughter) and any person with disabilities under the care of the deceased

Civil Law Act 1956
Limitation Period
3 years from the date of the death.
Calculation of the loss: -
- Below 30 years old
16 x (deceased’s annual net income – living expenses of the deceased) - Between 31 and 59 years old
(60 minus the age of the deceased, and then divide by 2) x (deceased’s annual net income – living expenses of the deceased) - 60 years old and above
no income
